Terms of Service
Please read these Terms of Service carefully before using AIKAM's AI-powered talent intelligence platform.
1. Acceptance of Terms
By registering as either an Employer or a Job Seeker, you agree to be bound by these Terms of Use.
2. Account Types and Services
- Employer (B2B) Accounts: Provides access to AI-native candidate sourcing, resume parsing, video interviewing, and coding assessments.
- Job Seeker (B2C) Accounts: Provides a personal dashboard for candidates to track interview progress, upcoming schedules, and application statuses.
3. Obligations of Employers (Data Fiduciaries / Controllers)
When utilizing Aikam to screen and interview candidates, the Employer agrees to:
- Obtain Consent: Lawfully obtain explicit, informed, and unbundled consent from candidates prior to using Aikam's AI tools to process their data.
- Ensure Human Oversight: Acknowledge that Aikam’s AI systems are assistive tools. The Employer is solely responsible for final employment decisions and must ensure meaningful human intervention.
- Prevent Algorithmic Bias: Monitor AI recommendations to ensure hiring practices remain equitable, non-discriminatory, and legally compliant.
- Indemnity: The Employer agrees to indemnify, defend, and hold harmless Aikam from and against any claims, liabilities, damages, regulatory actions, or losses arising out of or in connection with the Employer’s use of the platform, including any non-compliance with applicable laws.
4. Obligations of Job Seekers
When creating a personal account to track interviews, Job Seekers agree to:
- Provide authentic, accurate, and complete information.
- Not attempt to reverse-engineer, including impersonation, fraudulent activity, or misuse of the platform, manipulate, or extract source code from Aikam's coding assessment or video interview environments.
5. Auditable & Compliance-Enabled AI (SOC 2)
Aikam embeds "Regulation by Design" principles into our workflows.
- SOC 2 Assurance: We maintain SOC 2 Type II certification covering infrastructure, security, availability, and data integrity.
- End-to-End Visibility: We ensure that every AI-driven decision is fully traceable and explainable for legal and regulatory review. We provide end-to-end visibility of all data flows across the recruitment pipeline via trace data and server logs.
Aikam does not guarantee the accuracy, completeness, or suitability of AI-generated outputs and shall not be responsible for decisions taken based on such outputs.
6. Data Breach Notification
In the event of a personal data breach:
- For Job Seekers: Aikam will notify you and the relevant regulatory authorities without delay, providing a detailed report within 72 hours, where required under applicable law.
- For Employers: Aikam will notify the Employer without delay so the Employer can fulfill its legal obligations to notify its candidates and relevant regulators.
7. Intellectual Property
Aikam retains all rights, title, and interest in the platform, including its AI algorithms, underlying software, and assessment engines. Users retain ownership of the data they input but grant Aikam the necessary licenses to process this data to deliver the requested services. No rights, title, or interest in the platform, including its underlying technology, are transferred to users.
8. Termination and Governing Law
These Terms shall be governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Hyderabad, and proceedings shall be conducted in English.
